Supreme Court ratifies abortion authorization in case of rape

The Supreme Court has ratified today a ruling of a Chubut’s court authorizing an abortion in the case of a woman that got pregnant after being raped. However, the head of the Supreme Court Ricardo Lorenzini emphasized that the ruling doesn’t mean the start of possible abortion legalization. 

“The ruling is not opening any door for a possible legalization of the abortion. We are just saying that women who were victims of sexual abuse (raping) can now terminate their pregnancies as it was already contemplated by the Criminal law code but was not being respected by many courts and/or judges”   

“The Criminal law is very clear about it: pregnancy suspension is not punishable in case of rape of any kind.”

Today’s Supreme Court’s ruling ratifies a previous one ruled by a Chubut’s provincial court that authorized a medical abortion on a minor that had been victim of sexual assault.      

Lorenzino also explained that the Supreme Court’s ruling seeks “to make abortions of raped women no longer punishable” as so far was the case except for women with mental disorders.
