Gov’t moves in on Papel Prensa suit

The government will move forward next week with a request for a federal judge to accuse board members of Papel Prensa of money laundering as result of asset-stripping by the last military dictatorship.

The request will be carried out by Financial Information Unit (UIF) head José Sbatella and could lead to the government seizing assets from Papel Prensa.

“The UIF will start working next week on a case of money laundering by the last military government with assets belonging to people who disappeared. One of the cases is Papel Prensa, but there are several more,” Sbatella said, naming businessmen Eduardo Saiegh and the Laccarino brothers, who were kidnapped. Their assets were also seized by the military government.

Sbatella explained that crimes against humanity do not have a statute of limitations in Argentina, which makes all the appropriations by the dictatorship can still be tried in court.

“The investigations are still open because crimes against humanity do not expire, and there have been no sanctions yet,” Sbatella said. “The crimes committed are included in the Criminal Code in the chapter on financial crimes.”

The pending question is what will be done with the assets after the UIF’s court request. Sbatella said the “seizure of the assets will be requested, but they could be returned in the future.” According to the Criminal Code, a judge can decide to seize an asset until a final sentence is ruled. Then if the crime is proven, the assets can be seized and returned to their legitimate owners.

Sbatella also complained about the lack of a centralized national record of seized assets, which could make the removal or reinstitution of an asset much easier.
