Gov’t challenges ICSID judges
The government formally challenged on July 29 the appointments of Judge Francisco Orrego Vicuña as mediator in Argentina’s dispute with Spanish oil firm Repsol and Claus von Wobeser as the head of the International Centre for Settlement of Investment Disputes (ICSID)’s arbitral tribunal that will pronounce a ruling in the case, it was revealed yesterday.
Repsol is challenging Argentina at the ICSID over the country’s controversial nationalization of YPF last year.
The government called for Chilean Judge Orrego Vicuña to be removed as mediator due to his history of ruling against Argentina in three previous cases with fines amounting to US$472 million and his representation of Chile under Pinochet’s dictatorship. Von Wobeser has links to the Freshfields Bruckhaus Deringer law firm that is representing Repsol in its complaint against the government.
