ESMA repressor violates house arrest sentence
Former human rights abuser José Luis Magnacco’s home arrest privileges were suspended yesterday and he was ordered to be transferred immediately to the Marco Paz prison, After he was spotted walking around the Buenos Aires city neighbourhood of Barrio Norte
He was caught after a video had been published by the human rights organization HIJOS, where viewers can see Magnacco, 70, enter the Patio Bullrich shopping mall.
The judge made the order just after President Cristina Fernández de Kirchner demanded that the justice system act “with the national Constitution in hand” against the doctor guilty of stealing babies from people who were kidnapped and tortured in the last military dictatorship of 1976-1983. The judges who ordered his sentence declared that Magnacco had violated the legal terms in place.
Before being sent to prison, the elderly criminal will be given a full health check by the justice system’s medical experts taking into account any ailments he has. Federal Courthouse 5 requested that HIJOs provide the video that showed Magnacco walking in public.
Magnacco had been an obstetrician who worked in the ESMA navy mechanical school during the last dictatorship and was one of the 60 people who were declared guilty of crimes against humanity committed in that clandestine torture centre. He has been under house arrest since 2012.
Magnacco is under investigation in many other hearings and has already been sentenced to 15 years in prison and been declared guilty of complicity in the kidnapping of current deputy Victoria Donda, who was born in the ESMA when her mother was kidnapped in the clandestine centre.
