BA City to allow same sex marriages for foreigners

The City Government will allow foreigners that arrive in the country to get married –with either opposite sex or same sex partners- within five days of a request to the Civil Registry and only needing a temporary real address.

The measure was implemented by request of Mayor Mauricio Macri and was formally adopted in resolution 99.

“Law 26618 guarantees the right to start a family, and no kind of discriminatory rule can be used as an obstacle. Any female or male foreigner, regardless of their sexual orientation that enters, lives or visits Argentina will be able to get married according to the law, and nationality will not be considered as obstacle in the process.

The possibility of foreigners getting married is based on articles 14 and 20 of the National Constitution, on law 25781 (Migrations), 26618 (Civil matrimony) and decrees 660/11 and 660/12.

Foreigners wishing to get married in the City will need a certified copy of their passports, which will have to indicate temporary Buenos Aires address and length of the stay.

Buenos Aires province and Rosario already allow foreign same sex marriages. The same sex marriage was approved in July 2010.
