Council's 2006 reform also under target
Supreme Court to criticize Council of Magistrates

Argentina judiciary will return to duty tomorrow after the winter administrative time-off — this year extended due to H1N1 — and plans to release a full-of-critics document against to the Council of Magistrates (CM). The report will come after the opposition leaders insisted that the aforementioned council has been managed at will by the ruling party for the past three years.

The Council of Magistrates (CM) is meant to both promote new judges and dismiss those suspected of bad performance. The CM had been reformed in 2006 by a decree signed by Néstor Kirchner. Supreme Court's plan is to undergo a severe review and analysis of the council's performance during the past three years. In 2006 former president Néstor Kirchner reformed the number of CM members — based on a project presented to Congress by Cristina Fernández de Kirchner, who was senator by that time — from twenty to thirteen representatives and picked members who are aligned with the ruling party.

The Council of Magistrates is composed by law-makers, judges, and lawyers. According to the opposition it has lost its spirit of equality and it only works as another tool to benefit and increase the ruling party's power.

One highly criticized point is that with the current members, five out of the eight members respond to the Kirchenerite, the CM has the veto power for key decisions such as to declare the annul of the suspension of a judge accused of bad performance, or the selection of potential candidates to be promoted as either federal or national judges which has been pointed as being tendentious.

Sources have also indicated that the Supreme Court might also conduct a deep review of the charges pressed back in 2006 — seeking to annul the reform made by the Kirchners — which never moved forward and got rejected.
